PSYCHO BUNNY X TENNIS CANADA CONTEST
OFFICIAL CONTEST RULES
By participating in the Psycho Bunny x Tennis Canada contest (the “Contest”), each entrant agrees to be bound by these Official Contest Rules (the “Rules”) and by the interpretation of these Rules by the Sponsor, as defined below, with regards to all aspects of this Contest, including without limitation eligibility and/or disqualification of entrants and/or entries, which are final and binding without right of appeal.
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.
CONTEST PERIOD:
Contest begins on June 25, 2024 9:00 AM Eastern Time (“ET”) and ends on July 15, 2024 at 11:59 PM ET (the “Contest Period”).
ELIGIBILITY:
The contest is open to residents of Canada who have reached the age of majority in their province or territory of residence. Employees, officers, directors, representatives and agents of Psycho Bunny Inc. (the “Sponsor”), their respective advertising and promotional agencies, affiliated and related companies, and members of the immediate family (parents, children, siblings and spouse, regardless of where they live) and people living in the same household of such individuals are not eligible to enter the Contest. The Contest not sponsored or administered by or associated with Tennis Canada or the National Bank Open.
HOW TO ENTER:
No purchase necessary to enter to win. You may enter the contest by visiting the Contest website at https://www.psychobunny.ca/pages/tennis-canada-contest and clicking on the contest icon on the home page. An electronic entry form will appear on the screen. Fill out the entry form, while making sure that all the mandatory fields are filled out. Once filled, click the “Send” button. The sole determinant of the time for the purposes of a valid online entry in this Contest will be Sponsor’s server machine(s).
One (1) entry per person, regardless of method of entry. Sponsor will void all duplicate entries. All entries become the property of the Sponsor.
Entries must be received prior to the end of the Contest Period. Entries will be declared invalid if they are late, illegible, incomplete, damaged, forged, garbled or mechanically or electronically reproduced, or contain false information.
If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to use multiple names, identities, multiple accounts, or attempted to disrupt this Contest in any way (as determined by the Sponsor in its sole and absolute discretion), then they may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.
PRIZE WINNER SELECTION:
On July 16, 2024 at approximately 10:00 AM ET two (2) eligible entrants will be selected by random draw from among all eligible entries received during the Contest Period. After the draw, the Sponsor will notify the selected eligible entrants on July 16, 2024 by using the email address provided with the entry. If the eligible entrant cannot be reached for whatever reason and/or does not respond before July 18, 2024 by 5:00 PM ET via email, or there is a return of any notification as undeliverable, then the eligible entrant will be disqualified at the sole and absolute discretion of the Sponsor, and another eligible entrant will be randomly selected from the remaining eligible entries received in accordance with these Rules.
Before being declared the winner, the eligible entrant will be required to: (a) correctly answer, unaided, a time limited mathematical skill testing question; and (b) sign and return within two (2) business days of notification the Sponsor’s declaration and release form confirming compliance with these Rules, acceptance of the Prize as awarded and releasing the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns from any liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the Prize. If the selected entrant: (a) fails to correctly answer the skill testing question; or (b) fails to return the Contest documents within the specified time and as directed by the Sponsor, then he/she will forfeit the Prize and an alternate eligible entrant will be randomly selected from amongst the remaining eligible entries. Unless otherwise deemed appropriate by the Sponsor for the administration of the Contest based on the circumstances, no communications will be entered into except with selected entrant.
Upon satisfactory receipt of the Contest documents and other eligibility requirements, the Sponsor will coordinate digital delivery of the Prize to the Contest winner. The Platinum tickets will be transferred to the valid email address.
THE PRIZE AND APPROXIMATE RETAIL VALUE:
One (1) Prize will be awarded per winner. The Prize winner will receive two (2) Platinum tickets to the Montreal National Bank Open on Friday, August 9, 2024 (Night Session Only – ARV$1,100 per pair of tickets).
Approximate retail value (ARV) indicated in Canadian currency.
Prize winner and up to one (1) guest (a “Guest”) will be awarded one Prize. Guest must be at time of prize fulfillment the age of majority in the jurisdiction in which Guest resides, unless accompanied by a parent or legal guardian, and must complete and return a release and any other documentation required by Sponsor prior to prize award. If Guest is a minor in the Guest’s province of residence, minor’s parent/legal guardian must complete and return all releases on behalf of minor. If winner elects to participate in the prize with no Guest, no additional compensation will be awarded.
All meals, ground transportation and incidentals not described herein and incurred by Prize winner and winner’s Guest will be the sole responsibility of the Prize winner and/or winner’s Guest.
No refund or compensation will be made in the event of the cancellation or delay of the National Bank Open, except at Sponsor’s discretion. SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY CANCELLATIONS, DELAYS, DIVERSIONS OR SUBSTITUTIONS OR ANY ACT OR OMISSIONS WHATSOEVER BY ANY THIRD PARTIES.
In the event winner and/or Guest engages in behavior during any events associated with the Prize that (as determined by Sponsor in its sole and absolute discretion) is obnoxious, inappropriate, or threatening, illegal, or that is intended to annoy, abuse, threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to send winner and/or Guest home with no further obligations or compensation whatsoever to winner and/or Guest (which may, in Sponsor’s discretion, result in such winner’s disqualification from the Contest and forfeiture of the Prize. In the event winner or Guest engages in behavior during any events associated with the Prize that (as determined by Sponsor) is illegal, tortious, or subjects winner or Guest to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by winner or Guest as a result of such conduct. SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF THE PRIZE OR ANY OTHER ASPECT OF PRIZE WINNER’S OR GUEST’S ACCEPTANCE OR USE OF THE PRIZE.
The Prize must be accepted as awarded and is not transferable (except at the sole and absolute discretion of the Sponsor) or convertible to cash or credit. Sponsor reserves the right to substitute the Prize or any component thereof with a prize or prize component of equal or greater value, including, without limitation, but at Sponsor’s sole discretion, a cash award. For avoidance of doubt, no substitutions will be made except at Sponsor’s option.
ODDS OF WINNING:
Odds of winning depend on the number of eligible entries received during the Contest Period.
GENERAL CONDITIONS:
By entering the Contest and accepting the Prize, each selected entrant agrees irrevocably to the perpetual publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including, without limitation, print, broadcast or the Internet. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Contest judges with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries.
Subject to applicable laws, the Sponsor reserves the right to cancel, modify, suspend, extend, withdraw or amend these Rules or the Contest in any way, in the event of an error, accident, printing, administrative, or other error or any kind, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause that interferes with the proper conduct of the Contest as contemplated by these Rules without prior notice or obligation. Furthermore, the Sponsor reserves the right at its sole and absolute discretion to disqualify any individual from the Contest, and to ban that individual from any future promotion of the Sponsor, if the Sponsor finds or believes such individual to be tampering with the entry process or the operation of the Contest or website, to be acting in violation of the Contest rules, in a disruptive manner, or with intent to annoy, abuse, threaten or harass the Contest Parties, other entrants or any other person. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
Without limitation, the Sponsor and its respective officers, directors, employees, agents, representatives, successors (collectively, the “Released Parties”) will not be responsible or liable for:
- lost, stolen, delayed, damaged or misdirected claims or entries;
- any incorrect or inaccurate information, whether caused by Contest website users or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest;
- any error, omission, interruption, deletion, defect or delay in operation of the Contest website or any transmission in connection with the Contest;
- any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries;
- any problems with, or technical malfunction of, any telephone network or lines, computer online systems, servers or providers, computer equipment, software, or failure of email which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof;
- any injury or damage to entrants’ or to any other person’s computer or other device related to or resulting from participating or downloading materials in this Contest; or
- errors or omissions with respect to the printing or advertising of this Contest. If the Contest is not capable of running as planned for any reason, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever beyond the reasonable control of the Released Parties which corrupt or affect the administration, security or proper conduct of this Contest, the Sponsor reserves the right at its sole and absolute discretion to, without advance notice, terminate, extend or suspend the Contest, in whole or in part, or modify it in any way.
The Released Parties accept no legal liability, express or implied, regarding the use of the entry by the Sponsor, or for loss, damage or claims caused by the awarded Prize or the Contest itself. By entering the Contest, each entrant releases and holds harmless the Released Parties from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use of an entry, the Contest or any Prize (or a portion thereof) awarded. THE RELEASED PARTIES SHALL BE HELD HARMLESS BY AN ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.
The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained Herein.
ENGLISH/FRENCH VERSIONS:
In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and other disclosures or statements contained in any Contest related materials, including, but not limited to the French version of these Rules, and/or point of sale, print or other online advertising, the terms and conditions of these French Rules shall prevail, govern and control to the fullest extent permitted by law.
GOVERNING LAW / JURISDICTION:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of Entrants or Sponsor in connection with the Contest will be governed by and construed in accordance with the laws of the Province of Quebec, and the courts in the judicial district of Montreal shall have jurisdiction to settle any dispute or claim.
PRIVACY:
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with their entry only for the purpose of administering and fulfilling the Contest and in accordance with Sponsor’s Privacy Policy (available at: https://www.psychobunny.ca/pages/privacy-policy). Any information disclosed by Contest entrants as part of this Contest is being made to the Contest Sponsor and not to Tennis Canada or the National Bank Open. In order to administer the Contest, the Sponsor may be required by law to disclose the Contest winner’s personal information to a federal and/or provincial government agency whose mandate is to oversee the operation of promotional contests.
