PSYCHO BUNNY X TENNIS CANADA CONTEST
OFFICIAL CONTEST RULES
By participating in the Psycho Bunny x Tennis Canada contest (the “Contest”), each entrant agrees to be bound by these Official Contest Rules (the “Rules”) and by the interpretation of these Rules by the Sponsor, as defined below, with regards to all aspects of this Contest, including without limitation eligibility and/or disqualification of entrants and/or entries, which are final and binding without right of appeal.
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.
CONTEST PERIOD:
Contest begins on June 25, 2024 9:00 AM Eastern Time (“ET”) and ends on July 15, 2024 at 11:59 PM ET (the “Contest Period”).
ELIGIBILITY:
The contest is open to residents of Canada who have reached the age of majority in their province or territory of residence. Employees, officers, directors, representatives and agents of Psycho Bunny Inc. (the “Sponsor”), their respective advertising and promotional agencies, affiliated and related companies, and members of the immediate family (parents, children, siblings and spouse, regardless of where they live) and people living in the same household of such individuals are not eligible to enter the Contest. The Contest not sponsored or administered by or associated with Tennis Canada or the National Bank Open.
HOW TO ENTER:
No purchase necessary to enter to win. You may enter the contest by visiting the Contest website at https://www.psychobunny.ca/pages/tennis-canada-contest and clicking on the contest icon on the home page. An electronic entry form will appear on the screen. Fill out the entry form, while making sure that all the mandatory fields are filled out. Once filled, click the “Send” button. The sole determinant of the time for the purposes of a valid online entry in this Contest will be Sponsor’s server machine(s).
One (1) entry per person, regardless of method of entry. Sponsor will void all duplicate entries. All entries become the property of the Sponsor.
Entries must be received prior to the end of the Contest Period. Entries will be declared invalid if they are late, illegible, incomplete, damaged, forged, garbled or mechanically or electronically reproduced, or contain false information.
If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to use multiple names, identities, multiple accounts, or attempted to disrupt this Contest in any way (as determined by the Sponsor in its sole and absolute discretion), then they may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.
PRIZE WINNER SELECTION:
On July 16, 2024 at approximately 10:00 AM ET one (1) eligible entrant will be selected by random draw from among all eligible entries received during the Contest Period. The selected entrant will choose between the trip to Montreal, Quebec or Toronto, Ontario for the National Bank Open.
After the draw, the Sponsor will notify the selected eligible entrant on July 16, 2024 by using the email address provided with the entry. If the eligible entrant cannot be reached for whatever reason and/or does not respond before July 18, 2024 by 5:00 PM ET via email, or there is a return of any notification as undeliverable, then the eligible entrant will be disqualified at the sole and absolute discretion of the Sponsor, and another eligible entrant will be randomly selected from the remaining eligible entries received in accordance with these Rules.
Before being declared the winner, the eligible entrant will be required to: (a) correctly answer, unaided, a time limited mathematical skill testing question; and (b) sign and return within two (2) business days of notification the Sponsor’s declaration and release form confirming compliance with these Rules, acceptance of the Prize as awarded and releasing the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns from any liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the Prize. If the selected entrant: (a) fails to correctly answer the skill testing question; or (b) fails to return the Contest documents within the specified time and as directed by the Sponsor, then he/she will forfeit the Prize and an alternate eligible entrant will be randomly selected from amongst the remaining eligible entries. Unless otherwise deemed appropriate by the Sponsor for the administration of the Contest based on the circumstances, no communications will be entered into except with selected entrant.
Upon satisfactory receipt of the Contest documents and other eligibility requirements, the Sponsor will coordinate digital delivery of the Prize to the Contest winner. The Platinum tickets will be transferred to the valid email address for the chosen city. The Contest winner would be in contact with us via email to provide all the necessary information so that round trip airfare and accommodation arrangements can be made. Psycho Bunny apparel will be fulfilled by having Contest winner select products on the www.psychobunny.ca website, which will be shipped to their residence.
THE PRIZE AND APPROXIMATE RETAIL VALUE:
One (1) Prize (as defined below) will be awarded. The Prize winner will receive one (1) Prize package consisting of either:
Option 1 – Montreal – ARV$5,300
- 2 Platinum tickets to the Montreal National Bank Open on Saturday, August 10, 2024 (Day Session Only – ARV$1,100 per pair of tickets)
- Round trip economy airfare on Air Canada to Montreal, Quebec for 2 people (arrival Friday August 9, 2024, return Sunday August 11, 2024 – ARV$2,200 for 2 people based on round trip from Vancouver to Montreal)
- Accommodations for 2 people double occupancy (Montreal Fairmont The Queen Elizabeth – ARV$1,000 based on nightly rate)
- Psycho Bunny apparel ($1,000 (tax included) worth of online purchases at www.psychobunny.ca, excludes outwear)
Option 2 – Toronto – ARV$4,860
- 2 Platinum tickets to the Toronto National Bank Open on Saturday, August 10, 2024 (Day Session Only – ARV$660 per pair of tickets)
- Round trip economy airfare on Air Canada to Toronto, Ontario for 2 people (arrival Friday August 9, 2024, return Sunday August 11, 2024 – ARV$2,200 for 2 people based on round trip from Vancouver to Toronto)
- Accommodations for 2 people double occupancy (Toronto Hilton Downtown – ARV$1,000 based on nightly rate)
- Psycho Bunny apparel ($1,000 (tax included) worth of online purchases at www.psychobunny.ca, excludes outwear)
Approximate retail value (ARV) indicated in Canadian currency.
The chosen prize (“Prize”) shall include all the elements set forth in either option indicated above.
Prize winner and up to one (1) guest (a “Guest”) will be awarded one Prize. Guest must be at time of prize fulfillment the age of majority in the jurisdiction in which Guest resides, unless accompanied by a parent or legal guardian, and must complete and return a release and any other documentation required by Sponsor prior to prize award. If Guest is a minor in the Guest’s province of residence, minor’s parent/legal guardian must complete and return all releases on behalf of minor. If winner elects to travel or participate in the prize travel with fewer than one (1) Guest, no additional compensation will be awarded. If winner elects to travel or participate in prize travel with more than one (1) Guest, such additional persons shall be responsible for any and all costs associated with such travel and Sponsor shall not be responsible for coordinating the travel or accommodations of such additional person(s). Additional person(s) traveling with winner will not receive from Sponsor tickets to any of the Prize events, nor will any additional person(s) receive access through Sponsor any items included in the Prize. Winner and Guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.
Prize winner and winner’s Guest must be able to travel on dates determined by Sponsor. All meals, ground transportation and incidentals not described herein and incurred by Prize winner and/or winner’s Guest will be the sole responsibility of the winner and/or Guest. Sponsor is not responsible for any expenses incurred as a consequence of flight cancellation or flight delays. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Travel must be made through Sponsor’s agent and Sponsor shall determine airline and flight itinerary in its sole discretion. In the event a winner and/or winner’s Guest engage in behavior that (as determined by Sponsor in its sole discretion) is inappropriate, threatening, illegal or intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send the winner and/or winner’s Guest home with no further compensation.
The Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater retail value. Should winner elect to partake in any or all portions of his/her Prize with no Guest, the Prize will be awarded to winner and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All Prize details are at Sponsor’s sole discretion.
GENERAL RULES:
Contest Parties do not accept any liability for loss or damage resulting directly or indirectly from: (i) the awarding, acceptance, use or misuse of the Prize; (ii) participation in this Contest; or (iii) any travel related to the Prize.
The Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited or restricted by law. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.
By participating in this Contest, each entrant agrees (and agrees to confirm in writing): (i) that the Sponsor and their respective designees may use the entrant’s name, city/province/territory of residence, photograph, image, likeness, comments, and/or voice in any advertising, promotion or publicity, without further compensation, notice or approval, in any manner and in any medium (including without limitation the internet) that the Sponsor and their respective designees may deem appropriate; (ii) to release and hold harmless the Contest Parties from any and all liability for any loss, harm, damages, costs or expenses arising out of participation in this Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize, including without limitation, costs, injuries, losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, or from any and all claims of third parties arising therefrom; (iii) to grant Sponsor and their respective designees a perpetual, royalty-free, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display his or her entry, in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes.
Without limiting the generality of the foregoing, Sponsor and their respective designees reserve the right to use, publish, modify, display, and reproduce the entrant’s entry, in whole or in part, for promotional and marketing purposes without further compensation or notice. Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice and without any liability to any entrant. Entries are subject to verification and will be declared invalid if they are late, illegible, incomplete, damaged, forged, garbled or mechanically or electronically reproduced, or contain false information. The Contest Parties will not be responsible for lost, incomplete, late or misdirected entries, or for any failure of the Contest website during the Contest Period, including any problems or technical malfunctions of any telephone or data network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email, on-line, or Internet entry to be received by the Sponsor, or any combination thereof including, without limitation, any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the Contest.
PRIVACY:
Sponsor is collecting personal data about entrants for the purpose of administering this Contest. No further informational or marketing communications will be received by entrants, unless the entrant provides Sponsor with explicit permission to do so as indicated on the entry form. Please see Sponsor’s Privacy Policy at https://www.psychobunny.ca/pages/privacy-policy for information on their policy towards maintaining the privacy and security of user information.
INTELLECTUAL PROPERTY:
All intellectual property, including but not limited to trademarks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any of the Sponsor’s intellectual property without the express written consent of its owner is strictly prohibited.
